This Legal Notice (hereinafter, “Legal Notice”), establishes the conditions that regulate the use of the services of the information society that NAD makes available to users through the Web.
Thus, access to and use of the Website implies that the user (hereinafter, the “User”) accepts in its entirety and undertakes to comply fully with this Legal Notice, the terms and conditions, as well as the instructions or recommendations indicated in each specific case.
Access to the Web Site is free of charge, except for the cost of connection through the telecommunications network provided by the access provider contracted by the User.
NAD reserves the right to make, at any time and without prior notice, modifications and updates to the Web and its contents, configuration and presentation, including this Legal Notice, so we recommend reading it before each access and browsing the Web.
The User undertakes not to use the Website for fraudulent purposes, as well as not to carry out any conduct that could damage the image, interests and rights of NAD or third parties, and undertakes to use the Website, the Services and the contents included therein in a diligent, correct and lawful manner. In particular, the User undertakes to refrain from: deleting, evading or manipulating the copyright and other data identifying the rights of their owners incorporated into the contents of the Web, as well as technical protection devices, or any information mechanisms that may include such content.
Likewise, the User undertakes not to carry out any act with the purpose of damaging, rendering useless or overloading the Web Site, or preventing, in any way, the normal use and operation of the same.
In the event that you breach this Legal Notice or NAD reasonably suspects that you are in breach of this Legal Notice, NAD reserves the right to limit, suspend or terminate your access to the Web Site, taking whatever technical measures are necessary for that purpose.
Access to the information and some of the contents displayed on the Web does not require registration by Users, except for Customer access, which requires a user name and password.
The intellectual property rights on the layout of the contents of the Web (including the sui generis right on the database), its graphic design (look & feel), distinctive signs (trademarks, logos, trade names and slogan or advertising slogan), the underlying computer programs (including source codes), as well as the various elements that make up the Web (text, graphics, photographs, videos, etc.) belong to NAD or has, as the case may be, the right to use and exploit them, and in this sense they constitute works protected by the intellectual and industrial property legislation in force.
The use of the Web by the User in no way implies the transfer of any intellectual and/or industrial property rights over the Web, its contents and/or the distinctive signs of NAD.
To this effect, by means of this Legal Notice, except in those cases in which it is legally permitted, the User is expressly forbidden to reproduce, transform, distribute, publicly communicate, make available, extract and/or reuse the Website, its contents and/or the distinctive signs of NAD.
It is expressly and strictly forbidden to reproduce elements or contents of the Web for profit or commercial purposes.
The User acknowledges and accepts that the use of the Website is at all times at the User’s own risk and responsibility, and therefore NAD is not responsible for any misuse or improper use that may be made of the Website. For this purpose, it shall only be liable for damages that the User may suffer from the use of the Web, when such damages are due to our wilful misconduct.
In particular, NAD shall not be liable for:
– The content of the sites linked through the links included in the Web. In this regard, the terms contained in section 6 of this Legal Notice shall apply.
– Damages of any kind caused to the User’s computer equipment by viruses, worms, Trojans or any other harmful element. The User acknowledges that the use of the Internet network implies the assumption of a risk that his or her computer equipment may be affected by the elements listed above. To this end, it is the User’s responsibility, in any case, to ensure the availability of adequate tools for the detection and elimination of harmful electronic programs.
– Damages of any kind caused to the User as a result of failures or disconnections in the telecommunications networks that lead to the suspension, cancellation or interruption of the Web service. In this regard, the User acknowledges that access to the Web requires services provided by third parties outside the control of NAD (by way of example: telecommunications network operators, access providers, etc.) whose reliability, quality, continuity and operation does not correspond to NAD.
The Web Site includes or may include links that allow the User to access other Internet pages and portals (hereinafter, “Links”). In these cases, NAD acts as an intermediary service provider in accordance with Article 17 of the LSSI, and shall only be responsible for the content and services provided on the Linked Sites to the extent that it has actual knowledge of the unlawfulness and has not deactivated the link with due diligence. In the event that the User considers that there is a Link with illegal or inappropriate content, please notify NAD through rgpd@shad.es. In no case shall this communication entail the obligation to remove the corresponding link.
The existence of links in no way implies that NAD has actual knowledge or otherwise of the services and contents of these in case of unlawfulness, nor that it necessarily maintains agreements with those responsible or owners of the links.
Nor does the existence of such Links imply any recommendation, promotion, identification or conformity of NAD with the statements, content or services provided through the Links. Consequently, NAD is not responsible for the content of the Links, nor for their conditions of use and confidentiality policies, and the User is solely responsible for checking and accepting them each time he/she accesses and uses them.
The User and, in general, any natural or legal person who intends to establish a link from its page or site to the Web, must obtain prior written authorization from NAD. The establishment of such a link does not imply in any case the existence of a relationship between NAD and the owner or holder of the site or page where the link is established, nor the acceptance or approval by NAD of its contents or services.
In any case, NAD reserves the right to prohibit or disable links to the Web Site at any time, especially in cases of unlawful activity or content of the page or site in which it is included.
NAD makes every effort to ensure that navigation through this website is carried out under the best conditions.
It is forbidden to decompile, reverse engineer, sublicense or transmit in any way, translate or make derivative works of the computer programs necessary for the operation, access and use of this website and the services contained therein. The user of the website must refrain in any case from deleting, altering, evading or manipulating any protection devices or security systems that may be installed on it.
NAD is not responsible for any type of damage suffered by Users due to the use of browsers or versions other than the browsers for which this website has been designed.
In the event that any of the provisions contained in this Legal Notice is declared null and void, it will be withdrawn or replaced. In any case, such declaration of nullity shall not affect the validity of the rest of the provisions contained in this Legal Notice.
The use of the Website is governed by and construed in accordance with Spanish Law and it shall be understood that, by the use of the Website, the User agrees that any dispute or litigation arising between the User and NAD shall be dealt with in accordance with applicable law.
